LASTING POWER OF ATTORNEY
Another important area of life planning would be to create your Lasting Power of Attorney (LPA).
This allows you to appoint others whom you trust to make decisions on your behalf in the event you are unable or have lost the capacity to do so for yourself. The powers are created in respect of your Property & Affairs and Health & Welfare.
The drafting of the Powers themselves and the application process to register them is nothing short of a minefield.
Each separate LPA application is made up of no fewer than 20 pages of content for you to complete. The application will be rejected if a single box is left unticked or incomplete information is supplied. It’s critical to get this right first time to avoid paying repeat application fees for each re-submission or losing the chance to apply completely if the donor has gone on to lose their capacity in the interim.
